These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the online content provided on this website (hereinafter referred to as the “Service”) by the Global Environmental Forum, a General Incorporated Association (hereinafter referred to as the “Organization”).
All registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.
Article 1 (Scope and Amendments to the Terms)
- These Terms shall apply to all relationships between Users and the Organization in connection with the use of the Service.
- By beginning to use the Service, Users shall be deemed to have agreed to these Terms.
- Users shall be obligated to comply with these Terms in good faith.
- The Organization may amend these Terms as necessary. For material amendments, advance notice will be provided by posting on the Organization’s website or through other appropriate means. Continued use of the Service following such amendments shall be deemed to constitute the User’s consent to the revised Terms.
- The Organization may establish additional rules or individual provisions relating to the Service, which shall constitute part of these Terms.
- In the event of any inconsistency between these Terms and individual provisions, the individual provisions shall prevail.
Article 2 (User Registration)
- Registration shall be completed when an applicant agrees to these Terms, applies in the manner prescribed by the Organization, and receives notification of approval from the Organization.
- If the applicant is a minor, prior consent of a parent or legal guardian shall be required, and the use of the Service by such a User shall be under the consent and responsibility of the parent or guardian.
- To use the Service, Users must agree to these Terms and complete the purchase application in accordance with the procedures prescribed by the Organization. If inaccurate personal information is entered, the Service cannot be used.
- Purchases of the Service cannot be canceled and fees are non-refundable, except where cancellation or refund is required by law. Even in cases where duplicate purchase applications occur due to input errors or communication failures, the Organization shall not be held liable except in cases of willful misconduct or gross negligence.
- The Organization may refuse registration if it determines that any of the following apply, and it shall not be obligated to disclose the reason:
(1) False information is provided in the registration application
(2) The applicant has previously violated these Terms
(3) The Organization otherwise determines that registration is inappropriate
Article 3 (Management of User ID and Password)
- Users shall be responsible for managing their User ID and password for the Service at their own risk.
- Users may not, under any circumstances, transfer, lend, or share their User ID and password with any third party. If a login is made using a combination of User ID and password that matches the registered information, the Organization shall regard it as use of the Service by the User who registered the User ID.
- The Organization shall not be liable for any damages arising from the use of a User’s ID and password by a third party, except in cases of willful misconduct or gross negligence by the Organization.
Article 4 (Service Usage Agreement)
- Users shall pay the fees specified by the Organization in order to purchase and use the Service. The available period of use shall be posted on the Organization’s website.
- A Service usage agreement shall be deemed to be established when the User submits a purchase application and the Organization issues a notice of acceptance. In the case of online content, usage rights shall be granted to the User at the time the Organization makes the content available.
- Users shall review and confirm the information regarding fees, payment terms, periods of availability, and other related conditions from time to time.
- The Organization may, without prior notice, terminate the agreement if any of the following circumstances apply:
(1) The User violates these Terms
(2) Errors are found in the registered information, making fulfillment of the agreement difficult
(3) The relationship of trust between the Organization and the User is deemed to have been impaired - Matters relating to payment methods for the Service, as well as procedures for canceling paid membership subscriptions, shall be governed by methods separately prescribed by the Organization.
Article 5 (Intellectual Property Rights)
All copyrights and other intellectual property rights related to videos, photographs, and other content (hereinafter, the “Content”) provided through the Service shall belong to the Organization or other legitimate rights holders such as content providers.
Users may not reproduce, distribute, modify, or otherwise make secondary use of such Content without prior authorization.
Article 6 (Prohibited Acts)
- In using the Service, Users shall not engage in any of the following acts:
(1) Acts that violate laws or public order and morals
(2) Acts related to criminal conduct
(3) Infringement of copyrights, trademarks, or other intellectual property rights contained in the Service
(4) Acts that damage or interfere with the functions of the Organization’s servers or networks
(5) Commercial use of information obtained through the Service
(6) Acts that may interfere with the operation of the Service
(7) Unauthorized access or attempts thereof
(8) Use or provision of harmful programs such as computer viruses through or in connection with the Service
(9) Collecting or storing personal information of other Users
(10) Impersonating other Users
(11) Providing, transferring, selling, or otherwise disclosing Users’ email addresses or IDs to third parties
(12) Directly or indirectly providing benefits to anti-social forces in connection with the Service
(13) Acts that violate these Terms
(14) Any other acts deemed inappropriate by the Organization - If a User engages in any of the prohibited acts listed in the preceding paragraph, the Organization may suspend the User’s access to the Service without prior notice. A User who loses qualification under this Article shall not have the right to claim damages or exercise any rights against the Organization.
Article 7 (Suspension or Interruption of the Service)
- The Organization may suspend or interrupt the provision of all or part of the Service, without prior notice to Users, if it determines that any of the following circumstances apply:
(1) When maintenance, inspection, or repair work is required due to a failure of equipment used to provide the Service
(2) When provision of the Service becomes difficult due to force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters
(3) When computers or communication lines are interrupted due to accidents
(4) When the Organization otherwise determines that it is difficult to provide the Service - The Organization shall not be liable for any disadvantage or damage suffered by Users or third parties resulting from the suspension or interruption of the Service, regardless of the reason.
Article 8 (Modification or Discontinuation of the Service)
The Organization may, for unavoidable reasons, modify the content or name of the Service, or discontinue its provision. In such cases, notice will be given in advance to the extent reasonably possible.
If a period of unavailability occurs after fees have already been received, the Organization will provide refunds within a reasonable scope.
Article 9 (Usage Restrictions and Deregistration)
- The Organization may, without prior notice, restrict the use of all or part of the Service, or cancel a User’s registration, if any of the following apply:
(1) The User violates any provision of these Terms
(2) False information is found in the registration details
(3) The credit card provided by the User as a payment method is suspended
(4) Failure to fulfill payment obligations such as fees
(5) No response is received from the User for a certain period of time after contact from the Organization
(6) The Service has not been used for a certain period since the last usage
(7) The Organization otherwise deems the User’s use of the Service to be inappropriate - The Organization shall not be liable for any damages incurred by the User as a result of actions taken under this Article.
Article 10 (Withdrawal from Membership)
Users may withdraw from the Service by completing the prescribed withdrawal procedures.
Article 11 (Disclaimer of Warranties and Limitation of Liability)
- The Organization makes no warranty, whether express or implied, that the Service is free from factual or legal defects (including, but not limited to, defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security; errors, bugs; or infringement of rights).
- The Organization shall not be liable for any damages arising out of or in connection with the use of the Service by Users. However, if the agreement between the Organization and a User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act, the above disclaimer shall not apply. In such case, the Organization shall nevertheless not be liable for any damages arising from special circumstances (including cases where the Organization or the User foresaw or could have foreseen the occurrence of such damages) caused by default or tort due to negligence (excluding gross negligence) on the part of the Organization.
- The Organization shall not be responsible for any disputes, communications, or transactions between Users and other Users or third parties arising in connection with the Service.
Article 12 (Handling of Personal Information)
- The Organization shall maintain accurate and up-to-date personal information provided by Users, and shall take necessary measures to prevent unauthorized access, loss, damage, alteration, or leakage of personal information. Such measures include maintaining security systems, establishing management structures, and providing thorough staff training. The Organization shall strictly manage personal information.
- The Organization shall use personal information entrusted by Users only within the scope necessary to achieve the following purposes, which have been specified and publicly announced in advance. Among these purposes, the provision of information or advertisements related to products or services of partner companies shall be conducted only with the prior consent of the User:
(1) Sale and provision of the Service (including application processing and payment procedures)
(2) Provision of ancillary services (such as notifications of changes or discontinuation of the Service, and communications deemed necessary for business purposes)
(3) Support services, such as responding to inquiries regarding the Service
(4) Use and recording of access information (via the Internet, mobile sites, telephone, etc.) for the operation and management of the Service and handling of inquiries
(5) Provision of information and advertisements relating to products or services currently or in the future offered by the Organization or its partners (limited to companies bound by confidentiality agreements with the Organization) - The Organization shall not provide Users’ personal information to third parties without prior consent, except in the following cases:
(1) When required by law
(2) When it is necessary to protect human life, body, or property and it is difficult to obtain the User’s consent
(3) When it is particularly necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the User’s consent
(4) When cooperation is required with a government agency, local authority, or their contractor to execute affairs stipulated by law, and obtaining the User’s consent may impede such execution - The Organization may outsource part of its personal information handling operations to third-party contractors and may entrust personal information to them. In such cases, the Organization shall select contractors recognized as handling personal information appropriately, and shall stipulate necessary matters in contracts, including proper management of personal information and confidentiality obligations, to ensure appropriate management.
- If a User wishes to request disclosure of their personal information (including notification of the purpose of use, disclosure, correction, addition, deletion, suspension of use, erasure, or suspension of provision to third parties), the User shall contact the inquiry point specified in the Organization’s Privacy Policy. At that time, the Organization may request the submission of identification documents or other verification measures to confirm that the request is being made by the User themselves.
Article 13 (Notices and Communications)
Notices or communications between Users and the Organization shall be conducted in the manner prescribed by the Organization.
Unless a User submits a change request in the manner separately designated by the Organization, the Organization shall deem the currently registered contact information to be valid and shall provide notices or communications to that address. Such notices or communications shall be deemed to have reached the User at the time of transmission.
Article 14 (Prohibition of Assignment of Rights and Obligations)
Users may not assign, transfer, or offer as collateral their contractual position under the Service agreement, or any rights or obligations arising under these Terms, to any third party without the prior written consent of the Organization.
Article 15 (Governing Law)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Article 16 (Jurisdiction)
Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Organization’s headquarters.
Article 17 (Matters for Consultation)
In the event that any matter not stipulated in these Terms arises, or any doubt concerning the interpretation of these Terms occurs, the Organization and the User shall resolve such matters in good faith through mutual consultation.
